Wrestler Says Pro Matches Fake Nutt Sues Promoter McGuirk Claims Title Taken Away (By GREG RUBENSTEIN Of the World Staff)
The outcomes of professional wrestling matches and championships are decided ahead of time claims pro wrestler Bobby Eugene Nutt in a $267,000 lawsuit filed Monday in Tulsa District Court against local promoter Leroy McGuirk, Nutt moved to Tulsa from Kansas City, Mo in late 1979 after McGuirk promised him $100 per night to wrestle a $500-per-week minimum guarantee and use of the Junior Heavyweight Title belt for at least one year the lawsuit says “Such an offer was usual and customary in the professional wrestling business since championships are not decided by contests of wrestling skill the outcome of which is undecided until the end of the match but are rather decided beforehand by the promoter and choreographed to maximize the entertainment of the public" it says in the action.
Nutt who wrestles under the name Ron Starr received the title February 11 and alleges that he learned soon afterwards McGuirk intended to strip it from him “The defendant said he would take the title away from plaintiff and give it to one Les Thornton because Les Thornton would draw more money” Nutt claims McGuirk told him, according to the action, was then told by McGuirk he would meet Thornton in a 90-minute wrestling match March 10 that would “end in a draw to set the stage for a subsequent match in which plaintiff’s title would be taken from him and given to Thornton” .
The wrestler objected refusing to participate in the match McGuirk announced afterwards “in various places across the United States” that Nutt had been stripped of his title the wrestler claims. Nutt says losing the Junior Heavyweight title will cost him $250,000 in potential earnings. Nutt says he is afraid other promoters will not let him use the title his ability “to draw and please the public will be seriously questioned” and the loss stops him from “practicing and enjoying his profession”.
Presiding Judge William W Means signed a temporary restraining order Monday ordering McGuirk not to publish or communicate to anyone that Nutt is no longer the Junior Heavyweight Professional Wrestling Champion A hearing on a permanent injunction is set for April 3 at 10 am. The wrestler also wants $10,000 for earnings lost by refusing a trip to Japan after agreeing to come here, $2,000 moving expenses and an additional $5,000 because McGuirk paid him $50 per night rather than $100.
McGuirk declined to comment after talking to his lawyer John K Harlin Jr “I haven’t seen the petition yet so I have no way of knowing what the accusations are” Harlin said.
